What Is Wilderness?

BETCHA DON’T KNOW WHAT WILDERNESS IS.

 Designated wilderness is government land that has been placed by Congress under the management prescribed by public law 88-577, the Wilderness Act of 1964. The regulations under that act include the following:

Any person who knowingly and willfully violates wilderness regulations is subject to arrest, conviction and punishment by a fine of not more than $1,000 or imprisonment for not more than 12 months or both. 43 CFR 8560.6

Recreation

Recreation activities may be restricted or entirely excluded. 46 FR 85, I.C.2 Recreation and visitor use may be controlled through either direct or indirect methods.

Indirect methods include (46 FR 185, III.A.l.a):

 Obliteration of campsite improvements.

bullet

Minimizing the promotion of an outdoor experience in wilderness.

bullet

Rerouting primary transportation away from major destination areas.

bullet

Use or built-in frictions or obstacles, such as keeping roads at low standards.

Direct methods of controlling visitor use of wilderness include 46 FR 185,

bullet

Regulating the use of saddle horses and/or pack stock.

bullet

Requiring permits for specific areas or time periods.

bullet

Reducing the number of people in parties or the number permitted to stay overnight at specific locations.

bullet

Limiting total number of users.

bullet

Restricting both private and commercial canoe/boat beaching.

User Amenities

No facilities or improvements will be provided for the comfort and convenience of the visitor (46 FR 185, lll.A.2). Facilities for the convenience of the visitor are not compatible with preservation of wilderness character and therefore will not be provided in wilderness areas (46 FR 185, ll.B.4). Existing improvements or facilities not specifically permitted in the regulations will be removed. 46 FR 185, III.A.2

Existing trails and trail systems will be evaluated to determine if they are the minimum necessary to meet wilderness management objectives. Trails may be closed as a result of the evaluation. No trail will be more than two feet in width. 46 FR 185, lll.A.2.a.(2)

Bridges will be provided only when no other route or crossing is reasonably available. 46 FR 185, lll.A.2.a.(4).(a)

Signs will not be placed within the wilderness for the convenience of the user.  Informational or interpretive signs will not be used to mark streams, lakes, mountain peaks, passes or points or interest. 46 FR 185, lll.A.2

Camping will be regulated as follows (46 FR 185, lll.A.2.c.):

Camping is prohibited near lakes, streams, trails or other natural attractions.

Shelters or lean-tos will not be constructed.

Garbage may not be buried. 

bullet

Improvised camp structures constructed by visitors will not be permitted.

Contests, such as tests of physical endurance, foot races, canoe or boat races, competitive trail rides, survival tests, etc., shall not be permitted in wilderness areas. 46 FR 185, lll.A.4

Timber and Firewood

Trees, shrubs, and other vegetative products will not be sold or cut for non-wilderness purposes (46 FR 185, III.C.I). If campsites or cooking fires are permitted, fuel wood cutting will be limited to dead and down material 46 FR 185, II.B.l.a.

Hunting, Fishing and Trapping

Hunting, fishing and trapping may be regulated or discontinued if found to be inconsistent with preservation of an area's wilderness character. 46 FR 185, II.B.l.a

Habitat manipulation is only allowed to enhance wilderness values, and not to optimize habitat needs of any single wildlife species. Prescribed burning will not be permitted to improve wildlife utilization. 16 Fn f 85, 111.D.2

Fish-stocking of streams may de limited if likely to increase visitor usage. 46 FR 185, lll.D.4

Commercial trapping will not be permitted. 48 FR 185, 111.0.5

Grazing

Stock grazing may be restricted to achieve wilderness visitor management. 46 FR 105, 111.A.l.b.(6)

Permits for livestock operations will be issued only in areas where grazing was established at the time the wilderness was designated. 46 FR 185, III.A.l.b.(6)

Livestock numbers or animal unit months (AUMs) may be limited if shown to have an adverse impact on wilderness values such as plant communities, primitive recreation, and wildlife populations. House Report 96-1126 as cited in 46 Fn 185, 111.1-1.1

Mining

Subject to valid rights existing as of December 31, 1903, wilderness lands are withdrawn from all forms of appropriation under the mining laws. 46 Fn 185, 111.1.1

Cultural and Natural Resource Management

Archeological and historical sites will be subject to the forces or nature. Such sites will not be excavated, stabilized or improved for interpretation. Sites or structures not qualified for the National Register of Historic Places may be removed or obliterated. 46 FR 135, 111.8

Reforestation, in the absence of natural vegetation, will generally be prohibited.  46 FR 185, lll.C.4

Insect and disease outbreaks will not be artificially controlled (16 FR 185, 111.8.2).

Fire, insects, and disease will be allowed to play a natural role in wilderness ecosystems. 16 Fn 185·, II.B.la

Rodents shall be exempt from control programs. 16 FR 185, 111.D.6

No tools, equipment, or structures will be used where their purpose may be achieved without such items or with items less obtrusive to the wilderness character. 46 FR 185, 11.8.3

General Prohibitions

The following is prohibited in wilderness (43 CFR 8560, 1-2):

Commercial enterprises;

bullet

Temporary or permanent roads;

bullet

Aircraft landing strips, heliports, or helispots;

bullet

Use of motorized equipment, motor vehicles, motorboats or other forms of mechanical transport.

Note: Mechanical transportation is defined as: (I) any device for transporting personnel or material with wheels, tracks or skids, or by flotation, for traveling over land, water, or snow, and Is propelled by a nonliving power source contained or carried on or within the device or (2) a bicycle or hang glider. 43 CFR 8560.0-5(d)

bullet

Landing of aircraft (low over-flight not specifically prohibited, but discouraged - 46 FR 185, lll.K.12);

bullet

Dropping of materials, supplies, or persons from aircraft;

bullet

Structures or installations, including motels, summer homes, stores, resorts, organization camps, hunting and fishing lodges, or electronic installations;

bullet

Violating any order or regulation of an authorized officer.

bullet

Entry into or use of wilderness areas without a permit where such permits are required by an authorized officer.

General Regulatory Authority

An authorized officer may require permits for any use of wilderness, not limited to camping, campfires, and recreation livestock grazing, and may issue written orders to close or restrict the use of lands and water surfaces. 43 CFR 8560.1-1
